By accessing or using Monopolize.ai ("the Service", "the Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. These Terms apply to all users, subscribers, and affiliates of Monopolize.ai, operated by Intechformology ("we", "us", "our").
Monopolize.ai provides AI-assisted social media listening, competitor analysis, warm lead generation, content automation tools, business education resources (Business in a Box), and an affiliate commission program. The Platform is provided on a subscription basis with tiered access levels ranging from Entry ($25 USD/month) to Enterprise ($2,499 USD/month).
Monopolize.ai sources social media data through third-party API aggregators and data providers. While we work diligently to maintain connectivity across all listed platforms, we do not hold direct OAuth partnerships with all social media platforms listed on our service. Data access is provided through intermediary services that aggregate publicly available social media data.
We make no representation and accept no liability in relation to the continued availability of any specific social media platform's data within the Service. Platform connectivity is subject to change without notice due to:
The Service interacts with third-party services and depends on the availability of those services and the features they make available to us, which we do not control and which may change without notice. In no event shall Monopolize.ai be liable in the event a third-party service restricts, either temporarily or permanently, access to any platform data.
You acknowledge that your use of social media data accessed through the Platform must comply with the terms of service of each respective social media platform. You are responsible for ensuring your use of data obtained through the Service complies with all applicable laws and platform policies in your jurisdiction.
In the event of a platform data interruption, Monopolize.ai will:
If a platform that forms part of your selected platform allocation is unavailable for more than 7 consecutive days, you will receive a pro-rata service credit applied to your next billing cycle. Credits are calculated based on the number of affected platforms relative to your total allocated platforms for that billing period.
Credits are applied automatically to your account and do not require a request.
If a platform interruption affects one or more of your selected platforms and remains unresolved for more than 30 consecutive days, you may request either:
Refund requests must be submitted within 14 days of the 30-day threshold being reached. Refunds are processed within 10 business days to your original payment method.
Your affiliate referral network, commission earnings, and tier status are never affected by platform connectivity issues. Commission payments continue uninterrupted regardless of any temporary data source unavailability. Platform interruptions do not constitute grounds for affiliate commission suspension or network reassignment.
Subscriptions are billed monthly in advance. Your subscription renews automatically each month unless cancelled. You authorise Monopolize.ai to charge your nominated payment method on your billing date each month.
You may upgrade your subscription tier at any time. Upgrades take effect immediately and are prorated for the remainder of the current billing period. Downgrades take effect at the start of the next billing cycle.
You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing period. You retain access to the Service until your billing period ends. No partial refunds are issued for unused days following cancellation unless covered under Section 4.3.
Additional platform add-ons and search credit packs are charged at the time of purchase. Add-on platform charges recur monthly with your base subscription. Search credit packs are one-time purchases and do not roll over between billing periods. Credit packs are non-refundable once purchased and searches have been consumed.
Monopolize.ai operates a two-level affiliate commission program:
Commission rates for $999 USD and $2,499 USD tier referrals are 25% recurring only, with no one-time sign-up bonus.
To earn recurring commissions at a specific subscription tier level, you must maintain an active subscription at that tier or above. If you refer subscribers at a tier higher than your own active subscription, you will receive the one-time 50% sign-up bonus but will not receive ongoing Level 2 recurring commissions on that tier until you upgrade your own subscription to match or exceed that tier.
When you make two qualifying referrals at the next subscription tier above your current level, the system will notify you of your eligibility to upgrade. Upgrades are at your sole discretion. Monopolize.ai does not automatically upgrade your subscription.
Commissions are calculated on the 1st of each month for the previous month's qualifying subscriptions and paid within 5 business days via your nominated payout method (bank transfer, PayPal, or GCash where available). Minimum payout threshold: none. All earned commissions are paid regardless of amount.
Commissions are not paid on subscriptions that are refunded, charged back, or cancelled within 30 days of sign-up. Commissions earned through fraudulent referrals, self-referrals, or violations of these Terms will be reversed and may result in account termination.
Commission payments are made exclusively on active product subscriptions. No commission is paid on recruitment fees, sign-up fees, or any payment not tied to an active subscription.
Affiliates must clearly disclose their financial relationship with Monopolize.ai in all promotional content in accordance with applicable advertising standards including ACCC guidelines (Australia) and FTC guidelines (US).
Participation in the affiliate program does not guarantee any specific level of income. Earnings depend entirely on how actively members work their business and the activity of their network.
You agree not to use the Platform to:
All content, tools, course materials, Business in a Box methodology, and platform infrastructure remain the intellectual property of Intechformology. Your subscription grants you a limited, non-exclusive, non-transferable licence to use the Service for your own business purposes. You may not reproduce, distribute, or create derivative works from Platform content without written permission.
Your use of the Platform is also governed by our Privacy Policy, available at monopolize.ai/privacy. We collect and process personal data in accordance with applicable privacy laws. We do not sell your personal data to third parties.
The Service is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, Monopolize.ai expressly disclaims all warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that:
To the maximum extent permitted by applicable law, Monopolize.ai's total liability to you for any claim arising from or related to these Terms or your use of the Service will not exceed the greater of:
Monopolize.ai is not liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, even if we have been advised of the possibility of such damages.
You agree to indemnify and hold harmless Monopolize.ai, Intechformology, and their respective directors, officers, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any third party's rights.
We reserve the right to modify these Terms at any time. We will notify active subscribers of material changes via email or in-platform notification at least 14 days before the changes take effect. Continued use of the Service after that date constitutes acceptance of the updated Terms. If you do not agree to the updated Terms, you may cancel your subscription before the effective date.
We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time. We will provide reasonable notice of material changes where possible. We are not liable to you or any third party for any modification, suspension, or discontinuation of the Service.
These Terms are governed by the laws of New South Wales, Australia. Any disputes arising from these Terms will be subject to the exclusive jurisdiction of the courts of New South Wales, Australia.
